If you disagree with any part of these terms, you may not use the service. Your continued use of the service constitutes acceptance of these terms and any future modifications.
Pocket Card is a digital business card platform that enables users to create, customize, and share professional digital business cards. The service includes features such as QR code generation, customizable themes, contact information management, analytics tracking, company account management, and digital card sharing capabilities. We reserve the right to modify, suspend, or discontinue any feature at any time.
To use Pocket Card, you must create a user account and be at least 18 years of age. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account. You may not share your account credentials or allow others to use your account.
You retain ownership of any content you upload to Pocket Card, including profile images, contact information, and custom links. By uploading content, you grant Xenovia Technologies Limited a non-exclusive, worldwide, royalty-free license to use, reproduce, distribute, and display the content solely for the purpose of operating and providing the Pocket Card service.
You represent and warrant that you own or have the necessary rights to all content you upload and that such content does not violate any third-party rights, including copyright, trademark, privacy, or other personal or proprietary rights. You agree not to upload any content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
Company account owners are responsible for managing team members, monitoring usage, and ensuring compliance with these terms by all users under their account. Company owners may add or remove team members and manage their digital business cards. Each company account tier has specific user limits as outlined in the pricing structure.
Pocket Card provides analytics features that track card views, link clicks, and engagement metrics. By using the service, you acknowledge that your card interactions may be tracked and displayed to the card owner. We collect this data to provide valuable insights to our users about their networking effectiveness.
Pocket Card and its logo are trademarks of Xenovia Technologies Limited. All rights, title, and interest in and to the Pocket Card service, including but not limited to copyrights, patents, trademarks, trade secrets, software code, design elements, and user interface, are owned by Xenovia Technologies Limited or its licensors. You may not copy, modify, distribute, or reverse engineer any part of our service.
Pocket Card offers a subscription-based model with the following tiers:
We accept payments via bank transfer, link payments, and cash. All fees are in Trinidad and Tobago Dollars (TTD) and are non-refundable. Subscription fees are billed annually in advance. Users may cancel their subscription at any time by contacting customer support, but access will continue until the end of the current billing period with no prorated refunds.
You agree not to use Pocket Card for any of the following purposes:
Xenovia Technologies Limited reserves the right to terminate or suspend your account and access to the service at any time, with or without cause or notice, including for violation of these terms. Upon termination, your right to use the service will immediately cease. We may delete your account data after termination, though we may retain certain information as required by law or for legitimate business purposes.
The Pocket Card service is provided "as is" and "as available" without warranty of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted service. We do not guarantee that the service will be error-free, secure, or always available. You use the service at your own risk.
To the maximum extent permitted by law, Xenovia Technologies Limited shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the use or inability to use the service, including but not limited to loss of data, loss of profits, or business interruption, even if we have been advised of the possibility of such damages. Our total liability shall not exceed the amount you paid us in the twelve months prior to the claim.
You agree to indemnify, defend, and hold harmless Xenovia Technologies Limited and its affiliates, officers, directors, employees, agents, and contractors from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your use of the service, your violation of these Terms and Conditions, or your violation of any rights of another party.
While we implement reasonable security measures and backup procedures, you are solely responsible for maintaining backup copies of your content. We are not responsible for any loss or corruption of your data or content.
Any dispute arising out of or in connection with these Terms and Conditions shall be resolved exclusively through mediation in accordance with the applicable mediation rules in Trinidad and Tobago. If mediation is unsuccessful, disputes shall be resolved through binding arbitration. The decision of the mediator or arbitrator shall be final and binding on the parties.
These Terms and Conditions shall be governed by and construed in accordance with the laws of Trinidad and Tobago, without regard to its conflict of law provisions. Any legal action or proceeding shall be brought exclusively in the courts of Trinidad and Tobago.
Xenovia Technologies Limited reserves the right to modify these Terms and Conditions at any time. We will notify users of material changes via email or through the service. Changes will be effective immediately upon posting on the Pocket Card website. Your continued use of the service after changes are posted constitutes acceptance of the modified terms.
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
